Terms of Service

Welcome to Cinevva. By accessing or using our website at cinevva.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 13 years old and agree to these Terms and our Privacy Policy.
2. Description of Service
Cinevva is a platform for discovering and playing indie games through short-form gameplay videos. We provide:
- A curated feed of gameplay clips
- Instant browser-based game access
- Tools for game creators to submit and promote their games
- Community features for players and creators
Commissioned custom games. We also build custom games to order through Cinevva Studio. That work is governed by our Studio Services Terms, and, where a commissioned game collects personal data from your attendees or customers, our Studio Data Processing Terms. Where those terms conflict with these Terms on commissioned work, those terms control.
3. User Accounts
3.1 Account Creation
You may need to create an account to access certain features. You must provide accurate information and keep your account credentials secure.
3.2 Account Responsibility
You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access.
3.3 Account Termination
We may suspend or terminate accounts that violate these Terms or for any reason at our discretion with reasonable notice.
4. User Content
4.1 Your Content
You retain ownership of content you submit ("User Content"). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Service.
If you generate content using our AI tools, additional terms apply. See AI Generation Rights and, for music, Music Generation Rights & Royalties. If there is a conflict between those terms and this section, those terms control for generated content.
4.2 Content Standards
You agree not to submit content that:
- Infringes intellectual property rights
- Contains malware or harmful code
- Is defamatory, obscene, or harassing
- Violates any applicable law
- Impersonates others or is misleading
4.3 Content Removal
We may remove content that violates these Terms without notice.
5. Creator Terms
5.1 Game Submissions
Creators who submit games represent that they have the right to distribute their games on Cinevva.
5.2 Game Visibility on a Free Account
Games you create on a free account are public and remixable. Public means the game is playable by anyone with its link and has its own page in the Arcade. Remixable means another creator can start a new game from a copy of yours, with you credited as the source.
This is the default for every game on Cinevva, whatever your plan. What a paid plan adds is the ability to turn it off: on a paid plan you can take a game out of public view, and you can switch remixing off per game. On a free account those two controls are unavailable, and publishing itself is never restricted on any plan.
If you have made a purchase but do not hold a paid plan, you keep the per-game remixing control described in AI Generation Rights section 5.
Both controls apply going forward only. Games already private when this section took effect stay private, and remixes made while remixing was on remain valid and playable. Games you have already made private stay private if your plan lapses. Once you have made a purchase, these controls stay available to you; if you only ever held a subscription and it lapses, you will not be able to make further games private until you are on a paid plan again.
The license you grant us for a published game, and the rules for remixes of it, are set out in AI Generation Rights sections 5 and 6. Where that policy and this section conflict on games, that policy controls.
5.3 Revenue Sharing
Revenue sharing terms, if applicable, are governed by separate Creator Agreements.
5.4 Game Standards
Submitted games must comply with our content guidelines and not contain prohibited content as defined in Section 4.2.
6. Intellectual Property
6.1 Our Content
The Service, including its design, features, and content created by us, is protected by copyright, trademark, and other laws. You may not copy, modify, or distribute our content without permission.
6.2 Third-Party Content
Games and content from third-party creators remain the property of their respective owners.
6.3 Feedback
Any feedback you provide about the Service may be used by us without obligation to you.
7. Prohibited Conduct
You agree not to:
- Use the Service for illegal purposes
- Attempt to gain unauthorized access to the Service
- Interfere with the Service's operation
- Scrape or harvest data without permission
- Use bots or automated systems to access the Service
- Circumvent any access restrictions
- Harass other users
8. Billing, Credits, and Refunds
8.1 Credits
Everything you spend on Cinevva is denominated in credits. 100 credits are worth $1, and each generation deducts credits from your balance at the price shown before you run it (provider cost plus a 25% platform fee). All pricing is on the Plans page. Payments are processed through Stripe.
8.2 Plans
There is a free plan and there are paid plans:
- Free — 300 credits a month, no charge. Games you create are public and remixable (see 5.2), and generated content is subject to the promotional terms in AI Generation Rights.
- Standard — 2,000 credits a month, $15 monthly or $144 a year.
- Pro — 6,000 credits a month, $40 monthly or $384 a year.
Annual billing is 20% less than paying monthly. Paid plans include full commercial rights to what you generate and the per-game visibility controls described in 5.2.
Monthly plan credits roll over for one further month and then expire. Credits you purchase, earn, or receive at signup do not expire while your account is active.
8.3 Credit Packs
You can also buy credits outright, without a plan. Larger packs carry a bonus: 1,000 credits for $10, 2,600 credits for $20, and 7,500 credits for $50. Pack sizes and bonuses are shown on the Plans page and may change.
8.4 Signup, Bonus, and Promotional Credit
New accounts receive 300 credits at no charge. We may also grant free credits through achievement rewards, referrals, credit-pack bonuses, and other promotions. All credit granted at no charge is promotional: it can be spent on generations like any other credit, but no credit of any kind is redeemable for money (see 8.5). It never expires while your account is active.
Content generated before your first credit purchase is subject to the AI Generation Rights policy. Cinevva reserves commercial rights on those generations, except games, where we instead reserve publishing, showcasing, and remixing rights. Generations convert to your ownership automatically when you make your first purchase.
8.5 Refunds
A refund is a refund of money you paid us. We refund payments, not credits.
You can request a refund of a payment within 30 days of it being made by contacting [email protected]. Refunds are issued in the currency you paid, to the payment method you paid with, and we remove the credits that payment granted from your balance. A payment is refundable while the credits it granted are still on your balance; once you have spent them you have used the service they paid for, and that payment is no longer refundable.
Credits themselves are not money and are never refundable. They have no cash value and cannot be cashed out, withdrawn, transferred to another account, sold, or converted back into money, whether you bought them, earned them, or received them at signup or as a promotion.
If a generation fails, we return the credits it charged to your balance automatically. That is a correction to your balance, not a refund of money.
A plan can be cancelled at any time and runs to the end of the period you have paid for.
8.6 Price Changes
We may adjust per-generation credit prices, plan prices, and plan credit allotments with at least 14 days' notice. Existing credit balances are not affected by price changes. The price at the time a generation starts is the price charged.
9. Third-Party Services
The Service may contain links to third-party websites or services. We are not responsible for their content or practices.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CINEVVA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
12. Indemnification
You agree to indemnify and hold harmless Cinevva and its officers, directors, employees, and agents from any claims arising from your use of the Service or violation of these Terms.
13. Governing Law
These Terms are governed by the laws of Delaware, USA, without regard to conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or the Service will be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice on the Service or sending you an email. Continued use after changes constitutes acceptance.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Cinevva.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any right does not waive that right.
- Assignment: You may not assign these Terms. We may assign them freely.
