AI Generation Rights

This policy applies to all content generated with Cinevva's AI tools, including images, music, sound effects, 3D models, video, and games. It is part of the Terms of Service. If this policy conflicts with the Terms of Service, this policy controls for generated content. For music, the Music Generation Rights & Royalties policy adds royalty and release terms, and controls for music if the two conflict.
1. Definitions
"Output" means anything generated by the Service in response to your prompts or inputs, including images, audio, music, sound effects, 3D models, video, code, text, and game content.
"Game" means a playable project created or edited with Cinevva's game creation tools, including its Outputs as assembled in that project.
"Remix" means a new Game that another user starts from a copy of your published Game on the Service.
"Promotional Credit" means credit granted at no charge as described in Section 8.2 of the Terms of Service, including signup credit, achievement rewards, referral credit, top-up pack bonuses, and other promotions.
"First Purchase" means the first completed credit purchase on your account that is not refunded or reversed.
"Promotional Output" means Output generated before your First Purchase.
"Purchased Output" means Output generated after your First Purchase, and any Promotional Output that has converted under Section 7.
2. Purchase status at time of generation
Whether an Output is a Promotional Output or a Purchased Output is determined once, at the moment of generation, by whether your account has a First Purchase at that time. After your First Purchase, every Output you generate is a Purchased Output, even if the generation was funded by Promotional Credit such as a pack bonus or an achievement reward.
3. Promotional Output: your use
You may use Promotional Output for personal use, for non-monetized sharing, and anywhere on Cinevva, including in Games you build and publish on the Service. You may not monetize Promotional Output or use it commercially outside Cinevva. That includes selling it, licensing it, using it in ads or client work, shipping it in a game distributed outside Cinevva, and monetizing videos containing it.
This applies even if you never download the Promotional Output.
4. Promotional Output other than Games: Cinevva commercial rights
For Promotional Output other than Games:
You grant Cinevva an exclusive, worldwide, transferable, sublicensable, perpetual license to use, reproduce, distribute, publicly perform, publicly display, communicate to the public, sell, license, market, modify, adapt, create derivative works from, and otherwise exploit the Promotional Output for any commercial purpose.
For music, royalty and release terms in the Music Generation Rights & Royalties policy apply on top of this section.
This section does not apply to Games. Cinevva's rights in Games are described in Sections 5 and 6, and they are platform rights, not commercial exploitation rights.
5. Games: publishing, showcasing, and remixing
Cinevva does not claim commercial exploitation rights in your Games, whatever your purchase status. We will not sell or license your Game as our own.
For any Game you publish on the Service, you grant Cinevva a non-exclusive, worldwide, sublicensable license to host, run, distribute, publicly display, and promote the published Game on the Service and in Cinevva channels such as showcase pages, social media, and marketing materials, with credit to you as the creator.
Published Games are remixable by default: other users may start a new Game from a copy of your published Game. Remixes live on the Service and are themselves subject to this policy and the Terms of Service.
After your First Purchase, you can turn remixing off for your Games, per Game. Turning remixing off applies going forward only: Remixes created while remixing was on remain valid and playable. Before your First Purchase, remixing stays on for your published Games.
If you unpublish a Game, we stop promoting it and stop offering it for new Remixes going forward. Existing Remixes are not affected.
6. Quality maintenance on published Games
To keep published Games working well for players, we may apply technical fixes and polish to the published version of any Game, such as bug fixes, performance improvements, compatibility updates, and mobile control adjustments.
These changes do not affect your ownership of the Game, and we will not change your Game's creative content or gameplay design under this section. You can overwrite our changes at any time by republishing your own version.
7. Reclaim on first purchase
When you complete your First Purchase, every Promotional Output on your account other than Games automatically converts to Purchased Output at no extra charge. You don't need to ask, and there's no minimum purchase amount.
From the conversion date:
As between you and Cinevva, you own the converted Output.
Cinevva's exclusive commercial license to the converted Output ends, and we will not start any new commercial exploitation of it.
For Games, there is nothing to convert, because we never claim commercial exploitation rights in them. Your First Purchase instead unlocks the per-Game remixing control described in Section 5.
Exception: music Output that Cinevva has already released as a Label Release under the Music Generation Rights & Royalties policy does not convert. Your royalty participation for released tracks continues, and you can request delisting as described in that policy.
If the payment behind your First Purchase is refunded or charged back, the conversion is reversed from the date of the reversal, your Outputs return to Promotional Output status, and remixing is re-enabled for your published Games. The next completed purchase that is not refunded or reversed becomes your First Purchase.
8. Prior use stays valid
Conversion under Section 7, turning off remixing, and unpublishing are prospective only. Anything Cinevva, its licensees, or other users did while it was permitted remains fully authorized:
Licenses and sublicenses Cinevva granted before conversion remain in effect according to their terms.
Copies distributed, releases made, showcase placements, and marketing published earlier do not have to be recalled. Delisting of music Label Releases follows the music policy.
Remixes created while remixing was on remain valid and playable.
Conversion does not claw back revenue Cinevva earned before the conversion date and does not create any payment obligation for use that happened before the conversion date.
The same protection applies in reverse. If a conversion is reversed under Section 7, uses you made while the Output was a Purchased Output remain authorized, but any new commercial use outside Cinevva must stop.
9. Purchased Output: your rights
For Purchased Output:
As between you and Cinevva, you own the Purchased Output. You can use it commercially anywhere, including monetized videos, shipped games, ads, and client work.
You grant Cinevva a limited, non-exclusive, worldwide license to host, process, store, reproduce, and display the Purchased Output as needed to provide and secure the Service.
Cinevva will not use your Purchased Output for external marketing or promotions unless you opt in. For published Games, the publishing, showcasing, remixing, and quality maintenance terms in Sections 5 and 6 continue to apply.
10. Inputs
You represent and warrant that you own or have all necessary rights to provide your prompts, uploads, and other inputs, and that they do not infringe or misappropriate any third-party rights.
You grant Cinevva a worldwide, royalty-free license to use your inputs to operate the Service, including generating Output and enforcing this policy.
If an Output is a Promotional Output other than a Game, you also grant Cinevva the rights needed to exploit it as described in Section 4, including any inputs embodied in that Output.
We may block, restrict, or refuse generation if we believe content violates law, infringes rights, or creates elevated risk.
11. Enforcement
We may use automated systems and manual review to enforce this policy, prevent abuse, and protect rights holders.
If we believe you are monetizing Promotional Output outside Cinevva or otherwise violating this policy, we may restrict access to tools, remove content, suspend accounts, and pursue other remedies available to us.
