Music Generation Rights & Royalties

This policy applies to music generated using Cinevva tools (including the music generator at /tools/music). It is part of the Terms of Service and works together with the AI Generation Rights policy. If this policy conflicts with the Terms of Service or the AI Generation Rights policy, this policy controls for music generation.
1. Definitions
"Music Output" means any audio, lyrics, metadata, artwork, stems, renders, or other materials generated by the Service in response to your prompt or inputs.
"Inputs" means anything you provide to the Service, including prompts, text lyrics, and uploaded vocal recordings.
"First Purchase" means the first completed credit purchase on your account that is not refunded or reversed, as defined in the AI Generation Rights policy.
"Promotional Output" means Music Output generated before your First Purchase.
"Purchased Output" means Music Output generated after your First Purchase, and any Promotional Output that has converted under Section 6.
"Label Release" means distribution or exploitation by Cinevva under the Cinevva label, including release to streaming platforms, downloads, compilations, albums, sync licensing, marketing placements, and sublicensing.
"Net Receipts" means money we actually receive that is directly attributable to a specific Label Release, minus reasonable third-party fees and costs such as distributor/DSP fees, payment processing, refunds, chargebacks, and taxes collected and remitted.
2. Purchase status at time of generation
Your rights and our rights are determined by whether your account has a First Purchase at the time the Music Output is generated. After your First Purchase, every Music Output you generate is a Purchased Output, even if the generation was funded by promotional credit. Music Output generated before your First Purchase starts as Promotional Output and converts as described in Section 6.
3. Promotional Output: Cinevva commercial rights
For Promotional Output:
You grant Cinevva an exclusive, worldwide, transferable, sublicensable, perpetual license to use, reproduce, distribute, publicly perform, publicly display, communicate to the public, sell, license, market, modify, adapt, create derivative works from, and otherwise exploit the Promotional Output for any commercial purpose, including Label Release.
You may use Promotional Output for personal use, non-monetized sharing, and anywhere on Cinevva. You may not monetize Promotional Output or use it commercially anywhere outside Cinevva. That includes releasing it on streaming platforms, selling it, licensing it for a game or film, using it in ads, or monetizing videos containing it.
This applies even if you never download the Promotional Output.
4. Purchased Output: your rights
For Purchased Output:
As between you and Cinevva, you own the Purchased Output.
You grant Cinevva a limited, non-exclusive, worldwide license to host, process, store, reproduce, and display the Purchased Output as needed to provide and secure the Service.
Cinevva will not use your Purchased Output for external marketing or promotions unless you opt in. Opt-in can be controlled at the account level and overridden per track.
5. Inputs, lyrics, and uploaded vocals
You represent and warrant that you own or have all necessary rights to provide your Inputs, and that your Inputs do not infringe or misappropriate any third-party rights.
You grant Cinevva a worldwide, royalty-free license to use your Inputs to operate the Service, including generating Music Output and enforcing this policy.
If your Music Output is a Promotional Output, you also grant Cinevva the rights needed to commercially exploit the Promotional Output as described in Section 3, including any Inputs embodied in that output.
We may block, restrict, or refuse generation or release if we believe content violates law, infringes rights, or creates elevated risk for distribution.
6. Conversion to your ownership on first purchase
When you complete your First Purchase, every Promotional Output on your account automatically converts to Purchased Output terms at no extra charge, except Music Output that Cinevva has already released as a Label Release.
If conversion happens for an output:
Cinevva will stop new commercial exploitation of that output going forward.
Your royalty participation for that output ends as of the conversion date.
Conversion is prospective only. Exploitation by Cinevva or its licensees before the conversion date remains authorized, licenses and sublicenses granted before conversion remain in effect according to their terms, and conversion does not claw back revenue already earned or royalties already paid.
If an output was already released as a Label Release, it does not convert. Your royalty participation for that output continues under Section 7, and you can request delisting under Section 8.
If the payment behind your First Purchase is refunded or charged back, the conversion is reversed as described in the AI Generation Rights policy.
7. Royalties for Promotional Output
If Cinevva commercially exploits a Promotional Output as a Label Release, you are eligible for royalties for that output.
Royalty rate: 20% of Net Receipts attributable to that output.
Royalties are calculated and reported monthly. We may delay payment until your payable balance reaches $50.
Payments may require identity verification and tax forms. If you do not complete onboarding, we will accrue balances until you do, subject to applicable law.
We may make reasonable adjustments for refunds, chargebacks, fraud, duplicate payments, and distributor corrections.
8. Takedowns and delisting for Label Releases
If Cinevva has released a Promotional Output as a Label Release, you may request that we delist it going forward.
Delisting is not immediate. Third-party platforms and caches can take time to update, and we do not control their timelines.
Delisting does not claw back past revenue already earned, and it does not claw back royalties already paid.
9. Enforcement
We may use automated systems and manual review to enforce this policy, prevent abuse, and protect rights holders.
If we believe you are monetizing Promotional Output externally or otherwise violating this policy, we may restrict access to tools, remove content, suspend accounts, and pursue other remedies available to us.
